o Herndon-Based ePlus Acquires Software Business of Digital Paper
Herndon, Va. -- Broadening its content management offerings, Herndon-based
ePlus, a maker of cost management software for businesses, said on Wednesday
that it has acquired the software business of Alexandria-based Digital Paper,
a
provider of document access and collaboration software, for an undisclosed
price. The acquisition will allow ePlus to offer a content management system
that facilitates the sharing of large, unstructured documents such as
engineering
drawings, facilities diagrams, blueprints and technical manuals. ePlus said
that it
will continue to sell Digital Paper's products, as well as integrate them with
its
own, and will hire many key staff members.

o Germantown-Based Acterna Emerges from Chapter 11
Germantown, Md. -- Five months after falling victim to the telecommunications
downturn, Germantown-based Acterna, a maker of communications test and
measurement equipment, on Wednesday emerged from Chapter 11 bankruptcy
protection with a significantly stronger balance sheet. Under the company's
reorganization plan, approved by a bankruptcy court in late September,
Acterna's senior secured debt holders receive all of the company's equity
through a debt-for-equity swap. The company will now be privately held, with
long-term debt of approximately $190 million and quarterly cash interest
expense of less than $2 million. The company's reorganization plan was
confirmed by a bankruptcy court in New York on September 25. Acterna also
announced a new five-member board of directors.

o AOL Time Warner to Officially Drop "AOL" from Name on Thursday
Dulles, Va. -- Attempting to distance itself from the recent troubles at
Dulles-
based America Online, AOL Time Warner plans to officially drop the "AOL"
from its corporate name on Thursday. Time Warner Inc., as the parent will be
known, will trade under the ticker symbol "TWX." The company's web site also
will change to www.timewarner.com, and its subsidiary currently named "Time
Warner Inc." will become "Historic TW Inc." The move comes nearly three
years after the $112 billion merger that created the media giant. America
Online
has been losing subscribers to faster broadband connections and is under
investigation by the Securities and Exchange Commission. The name change
reportedly is not a precursor to the spinoff or sale of AOL.

o Cingular Wireless to Swap Eastern Shore Cellular Property
Ocean City, Md. -- Cingular Wireless said that it will swap its Michigan-based
cellular business unit in exchange for Dobson Communications' operation on the
Eastern Shore of Maryland. The Maryland property covers a population of about
471,000, including the cities of Ocean City, Salisbury, Easton and Cambridge.
As part of the deal, Cingular will pay Dobson $23 million in cash. The
companies have also agreed to assist one another in building out their
networks
in Maryland and Michigan.

o Man Claims DC-Based RIAA Filed Copyright Suit Against Him in Error
Washington, DC -- A digital civil liberties group has asked the DC-based
Recording Industry Association of America (RIAA) to drop its suit against a
Los
Angeles man who claims that the organization erred when it sued him for
copyright infringement. Though the RIAA said that Ross Plank illegally
downloaded Latin songs through the Kazaa file-sharing service, Plank contends
that he did not have the proper software installed on his PC during the time
in
question and does not even listen to Latin music. The San Francisco-based
Electronic Frontier Foundation (EFF) has asked the RIAA to dismiss the suit.
The RIAA so far has sued 261 individuals for using file-sharing software to
infringe on copyrights, and has withdrawn just one suit due to a case of
mistaken
identity. "The recording industry's 'sue first and ask questions later,'
policy
caused this problem," said Cindy Cohn, the legal director of the EFF.

o Lansinger to Again Takes Helm of Maryland Business Incubation Association
Baltimore -- The Maryland Business Incubation Association (MBIA), an
organization that advocates for the advancement of business incubation in
Maryland, on Wednesday named Ann Lansinger as its president. Lansinger, the
executive director of the Emerging Technology Centers in Baltimore, takes on
the role of president after holding the same position during the
organization's
first two years. She succeeds Ed Sybert, who has resumed his prior
responsibilities in the Biotechnology Program of the Maryland Technology
Enterprise Institute. The MBIA was formed in 2001 to increase the awareness
and understanding of business incubation. It will host the National Business
Incubation Association's 2005 National Conference in Baltimore.

o Survey: 78% of U.S. Teens Think File-Sharing Should Be Legal
Rochester, N.Y. -- A recent survey of 13-18 year-olds found that two-thirds of
U.S. teens oppose fining individuals who offer copyrighted music online for
other people to download, and three-quarters said they think sharing songs
with
others should be legal. The poll, conducted by Harris Interactive, found that
only
13% of teens believe that people who offer copyrighted music on their
computers for others to download should be fined, and that only 34% of teens
had ever paid for a music download.

Can Website Terms Create a Binding Online Contract without a Click?
Almost every commercial website contains a link to terms and conditions of use
or other legal requirements purporting to govern a user's visit to the site.
Initially, U.S. courts had varying views about the enforceability of terms and
conditions that were simply hyperlinked to a website, but not formally
"accepted" by the user. In Specht v. Netscape Communications, a federal
district
court held, and an appellate court affirmed, that persons who had downloaded
Netscape's software were not bound by the arbitration clause in the license
agreement on Netscape's website because the users had not affirmatively
assented to the terms of that license agreement. Recently, however, at least
one
court has indicated that it may be more generous to online terms and
conditions,
and may be willing to find that user assent may be indicated by affirmative
actions other than clicking an "I Accept" box, at least in certain
circumstances.

and voice networking contract worth $1.7 million from Catonsville-based
Erickson Retirement Communities, a builder and manager of retirement

headquarters. Erickson previously contracted with Qwest Communications.
